Slater Vecchio LLP is investigating a class action lawsuit against Casper concerning certain mattress models containing fiberglass as a fire retardant. Our initial investigation has revealed reports that these mattresses release fiberglass particles that can escape into consumer’s homes, causing a range of issues for both health and property.
Reports reflect that fiberglass can escape and spread into bedding, carpets, clothing, furniture, and air vents, which can be very difficult and expensive to remove. Reported health effects include skin and eye irritation, breathing problems, and other health concerns for family members and pets in the home.
We are investigating how many Canadians have been affected by Casper’s failure to adequately warn about the potential health risks and damage to property from its fiberglass mattress models, including inadequate information around the risks of use and exposure resulting from removing the zippered covers on these mattresses.
A class action is a legal case through which one person makes a claim to the Court on behalf of a similarly situated class of people who have the same or a similar legal claim. A class action seeks to hold a defendant or defendants responsible for their conduct that affects each member of the class by resolving issues that are common to the class in the same legal proceeding, instead of each class member bringing a claim individually.
The individual who first files the claim must ask the Court for permission to proceed as a class action. If permission is granted (referred as “authorized” in Quebec, and “certified” in all other Canadian provinces) and the case may proceed as a class action, the Court will appoint an individual as “Representative Plaintiff” to represent the best interests of the class during the litigation and will define the class group. Each person who meets the criteria of the class group is considered a “Class Member”.
The proposed class action is intended to represent Canadian residents who owned or used certain Casper mattress models that contain fiberglass and who suffered losses or health issues as a result. This includes people who experienced fiberglass spreading into their home or onto their belongings, and people who developed symptoms they believe may be linked to fiberglass exposure.
The mattresses we are focusing on include, but may not be limited to, the following Casper models sold in Canada: Original, Original Hybrid, Nova Hybrid, Wave Hybrid, and Casper Select. If you purchased, owned, or regularly slept on one of these mattresses in Canada, and you had problems with fiberglass escaping or needed to pay for cleaning, replacement of belongings, medical visits, or other related costs, you may be part of the proposed class.
