This class action seeks a full or partial refund of the price paid by consumers in Canada who, since October 5, 2010, have purchased maple syrup from the producer 9227-8712 Québec Inc., also doing business as “Érablière Steve Bourdeau”, “Le sirop Angela” or “L’Érabeille”, including those persons who purchased such a can in an establishment operated by Metro inc. (e.g., Metro, Adonis, Super C), Sobeys Group inc. (e.g., IGA), Groupe Épicia Inc. (e.g., Val-Mont) or Loblaw Companies Limited (e.g., Maxi, Provigo or Loblaws).
In short, the lawsuit alleges that consumers’ consent was vitiated by the producer’s false representations regarding the composition, quality, purity, or origin of the maple syrup, or that the product otherwise contains a quality defect.
The claim also seeks to obtain compensatory and punitive damages in an amount to be determined.
A class action is a legal case through which one person makes a claim to the Court on behalf of a similarly situated class of people who have the same or a similar legal claim. A class action seeks to hold a defendant or defendants responsible for their conduct that affects each member of the class by resolving issues that are common to the class in the same legal proceeding, instead of each class member bringing a claim individually.
The individual who first files the claim must ask the Court for permission to proceed as a class action. If permission is granted (referred as “authorized” in Quebec, and “certified” in all other Canadian provinces) and the case may proceed as a class action, the Court will appoint an individual as “Representative Plaintiff” to represent the best interests of the class during the litigation and will define the class group. Each person who meets the criteria of the class group is considered a “Class Member”.
All persons in Canada who, since October 5, 2010, purchased a can of maple syrup produced by 9227-8712 Québec inc., including those persons who purchased such a can in an establishment operated by Metro inc., Sobeys Group inc., Groupe Épicia Inc. or Loblaw Companies Limited.
