Settled
The below class actions are now certified as against the Hirschvogel defendants only:
A proposed settlement has been agreed upon by the parties to resolve the claims against Hirschvogel in both actions.
This Settlement will now have to be approved by the courts. The Settlement Approval hearing will take place on January 28, 2027.
The deadline to opt-out of either (or both) of these actions, or to object to the proposed Settlement is December 15, 2026.
You can consult the proposed Settlement Agreement on the “Documents” tab.
Hirschvogel has agreed to settle the claims made against it in both class actions in exchange for a full release of the claims against it and their related entities relating to the alleged price-fixing of forged aluminum and steel products. Hirschvogel agreed to pay CDN $2,500,000.00 for the benefit of the settlement classes.
Hirschvogel also agreed to provide cooperation to the Plaintiffs in pursuing the Steel Proceeding and the Aluminum Proceeding against the remaining defendants.
At this time, these sums will not be distributed to class members. They will be held by class counsel, in trust, until such time as the pending litigation with all other defendants is resolved.
The settlement is a resolution of a contested claim and Hirschvogel does not admit any liability, wrongdoing or fault.
A class action is a legal case through which one person makes a claim to the Court on behalf of a similarly situated class of people who have the same or a similar legal claim. A class action seeks to hold a defendant or defendants responsible for their conduct that affects each member of the class by resolving issues that are common to the class in the same legal proceeding, instead of each class member bringing a claim individually.
The individual who first files the claim must ask the Court for permission to proceed as a class action. If permission is granted (referred as “authorized” in Quebec, and “certified” in all other Canadian provinces) and the case may proceed as a class action, the Court will appoint an individual as “Representative Plaintiff” to represent the best interests of the class during the litigation and will define the class group. Each person who meets the criteria of the class group is considered a “Class Member”.
If you purchased a vehicle, anywhere in Canada, containing Forged Aluminum Products or Forged Steel Products or a replacement part for your vehicle that was made from Forged Aluminum or Steel Products between 2002 until 2018, you may be affected by this class action settlement.
The proposed settlement will bind all Class Members who do not opt out of the proceeding.
If you want to be a member of the Class Actions, you do not need to do anything. The Settlement Funds will be held in trust until these class actions resolve against the remaining non-settling defendants.
If you do not want to participate in one, or in both, of these class actions, you must complete and send an Opt-Out Form by December 15, 2026 (the “Opt-Out Deadline”) to class counsel by email or by courier at the addresses listed on the form.
This is your only opportunity to exclude yourself from either of these class actions, as they remain ongoing against the other defendants.
The Opt-Out form is available on the Documents section on this webpage.
Please note that if you opt-out by the Opt-Out Deadline, you will not be entitled to participate in the Settlement.
If you object to the terms of the settlement, you may communicate your objection before December 15, 2026.
To deliver an objection to the settlement, provide a written statement containing the reasons for your objection to Class Counsel.
