Meta’s Invasion of Privacy on Android Devices Class Action - Canada

What is this lawsuit about?

Meta allegedly circumvented legitimate internet protocols and communicated data they obtained from users’ web browsing activity on apps such as Google Chrome, Mozilla Firefox and Microsoft Edge, to their own native apps installed on the Android user’s device (such as Facebook and Instagram) which then, sent the data from those Meta apps to the Meta server.

By linking the Android user’s web data activity on non-Meta websites or apps to the Meta apps installed on the user’s Android devices (such as Facebook or Instagram), Meta tracked the web browsing activity of Android users. As a result, Meta was allegedly able to de- anonymize the Android user’s online activity and collect information about the Android user’s web browsing activity.

Through this alleged conduct, Meta would have systematically misled Android users by fostering misplaced confidence in their privacy protections while covertly harvesting personal data.

What is a class action?

A class action is a legal case through which one person makes a claim to the Court on behalf of a similarly situated class of people who have the same or a similar legal claim. A class action seeks to hold a defendant or defendants responsible for their conduct that affects each member of the class by resolving issues that are common to the class in the same legal proceeding, instead of each class member bringing a claim individually.

The individual who first files the claim must ask the Court for permission to proceed as a class action. If permission is granted (referred as “authorized” in Quebec, and “certified” in all other Canadian provinces) and the case may proceed as a class action, the Court will appoint an individual as “Representative Plaintiff” to represent the best interests of the class during the litigation and will define the class group. Each person who meets the criteria of the class group is considered a “Class Member”.

This class action is brought on behalf of:

• All persons in Canada who used an Android device, that had Facebook or Instagram installed, to browse the web between September 2024 and June 3, 2025
• or such other class definition as may be approved by the Court
