This lawsuit concerns a data breach in June 2025 at WestJet, where full names, dates of birth, email addresses, mailing addresses, phone numbers, genders, recent travel booking history including travel booking numbers, information about the travel document used when travelling with WestJet (such as passport or other government issued identification document) and other sensitive data may have been compromised due to inadequate security measures.
The information compromised may include:
(a) Personal Identifiers:
i. full legal names, dates of birth, home addresses, email addresses, phone numbers, gender, marital status;
(b) Travel-Related Data:
i. passport, permanent residence card, immigration visa, and/or other government-issued identification information, citizenship;
ii. travel need information, such as accommodations requested or filed complaints, and medical information;
iii. travel information linked to other people travelling under the same booking number, such as family members; and
(c) Loyalty Data:
i. WestJet Reward ID number, points balance.
The class action seeks compensation for affected individuals and aims to ensure WestJet implements stronger data protection protocols to prevent future breaches.
A class action is a legal case through which one person makes a claim to the Court on behalf of a similarly situated class of people who have the same or a similar legal claim. A class action seeks to hold a defendant or defendants responsible for their conduct that affects each member of the class by resolving issues that are common to the class in the same legal proceeding, instead of each class member bringing a claim individually.
The individual who first files the claim must ask the Court for permission to proceed as a class action. If permission is granted (referred as “authorized” in Quebec, and “certified” in all other Canadian provinces) and the case may proceed as a class action, the Court will appoint an individual as “Representative Plaintiff” to represent the best interests of the class during the litigation and will define the class group. Each person who meets the criteria of the class group is considered a “Class Member”.
This lawsuit aims to represents all individuals, residing anywhere in the world (or, subsidiarily in British Columbia or Canada) who were WestJet customers on or before June 13, 2025 and whose information was included or disclosed in the WestJet Data Breach.
