A SETTLEMENT IN THIS ACTION HAS BEEN REACHED. ON NOVEMBER 4, 2022, THE SUPREME COURT OF BRITISH COLUMBIA APPROVED THE SETTLEMENT. IF YOU ARE A MEMBER OF THE CLASS, THIS AFFECTS YOUR LEGAL RIGHTS, PLEASE SEE BELOW<\/u><\/strong>.<\/p>

Pursuant to the Settlement, Capcom will pay CAD $125,000 to effectuate the Settlement, inclusive of any distributed amounts to\u00a0 Class\u00a0 Members,\u00a0 class counsel fees,\u00a0 taxes and disbursements,\u00a0 any honouraria for the representative plaintiffs, any charitable donations paid for the benefit of Class Members to the Law Foundation, and administration expenses (the \u201cSettlement Amount\u201d). The balance of the Settlement Amount after the payment of class counsel fees, taxes and disbursements, administration expenses and any honoraria for the representative plaintiffs is available for distribution to Class Members (the \u201cDistribution Amount\u201d).<\/p>

This Settlement resolves the Action for all Class Members as against Capcom.\u00a0 A full release of all claims in the Action has been granted to Capcom.\u00a0 This Settlement represents a resolution of disputed claims and Capcom does not admit any wrongdoing or liability.<\/p>

The Settlement Funds will be distributed to Class Members in two stages. ALL CLAIMS FORMS MUST BE SUBMITTED BY FEBRUARY 3, 2023<\/strong>.<\/p>

Stage 1:<\/strong> Class Members can submit claims with supporting evidence for direct losses caused by the Data Breach and will be eligible for reimbursement of such losses.\u00a0 The evidence of loss must be objective,\u00a0 reliable and credible,\u00a0 such as credit card statements,\u00a0 invoices, fraud reports,\u00a0 and receipts of out-of-pocket expenses incurred.\u00a0 Class Members are entitled to submit a claim for the following loss types:<\/p>

  • unauthorised charges on a class member\u2019s bank account or credit card;<\/li>
  • unauthorised lending;<\/li>
  • credit monitoring, credit insurance, identity theft protection;<\/li>
  • credit reports; and<\/li>
  • other costs, losses and\/or reimbursed expenses.<\/li><\/ul>

    Class Members who submit an approved substantiated claim will also be entitled to receive reimbursement for two hours of lost time, calculated at a rate of CAD $20.00 per hour, for each category of approved substantiated loss.<\/p>

    If the available Distribution Amount is insufficient to pay all approved substantiated claims, each claim will be proportionally reduced.\u00a0 No additional contributions will be made by Capcom.<\/p>

    Stage 2:<\/strong> Following the distribution, if there is any Distribution Amount remaining, class counsel will disburse such amount on a pro-rata basis to all Class Members.<\/p>

    Aux termes du r\u00e8glement, Capcom versera 125,000\u00a0$\u00a0CA, qui comprend toutes les indemnit\u00e9s vers\u00e9es aux membres, les Honoraires des avocats du groupe, les taxes et les d\u00e9pens, tout versement \u00e0 titre gratuit accord\u00e9 au Demandeur, et tout don vers\u00e9 au b\u00e9n\u00e9fice des Membres \u00e0 la Law Foundation, ainsi que frais d\u2019administration (le \u00ab\u00a0Montant du R\u00e8glement\u00a0\u00bb). Une fois les Honoraires des avocats du groupe, les taxes et les d\u00e9pens, les frais d\u2019administration et tout versement \u00e0 titre gratuit accord\u00e9 au Demandeur sont vers\u00e9 du Montant du R\u00e8glement, les fonds restants seront distribu\u00e9s aux Membres.<\/p>

    Ce r\u00e8glement r\u00e8gle toutes les r\u00e9clamations pr\u00e9sent\u00e9es contre Capcom par le Groupe dans le cadre de cette action. Une d\u00e9charge compl\u00e8te a \u00e9t\u00e9 \u00e0 Capcom. Ce r\u00e8glement ne constitue pas une reconnaissance de responsabilit\u00e9 de la part de Capcom.<\/p>

    Les indemnit\u00e9s seront distribu\u00e9es aux Membres en deux \u00e9tapes. TOUT FORMULAIRE DE R\u00c9CLAMATION DOIT \u00caTRE SOUMIS AU PLUS TARD LE 3 F\u00c9VRIER 2023<\/strong>.<\/p>

    \u00c9tape 1 :<\/strong> Les membres du groupe peuvent soumettre des r\u00e9clamations avec des preuves \u00e0 l’appui pour les pertes directes caus\u00e9es par la violation de donn\u00e9es et seront admissibles \u00e0 un remboursement de ces pertes. Les preuves de la perte doivent \u00eatre objectives, fiables et cr\u00e9dibles, telles que les relev\u00e9s de cartes de cr\u00e9dit, les factures, les rapports de fraude et les re\u00e7us des d\u00e9penses engag\u00e9es.\u00a0 Les membres du groupe ont le droit de soumettre une r\u00e9clamation pour les types de pertes suivants :<\/p>

    • des d\u00e9bits non autoris\u00e9s sur le compte bancaire ou la carte de cr\u00e9dit d’un membre du groupe ;<\/li>
    • des pr\u00eats non autoris\u00e9s;<\/li>
    • surveillance du cr\u00e9dit, assurance-cr\u00e9dit, protection contre le vol d’identit\u00e9 ;<\/li>
    • des rapports de cr\u00e9dit; et<\/li>
    • les autres co\u00fbts, pertes et\/ou d\u00e9penses rembours\u00e9es.<\/li><\/ul>

      Les Membres qui soumettent une r\u00e9clamation approuv\u00e9e et l\u00e9gitime auront \u00e9galement le droit de recevoir le remboursement de deux heures de temps perdu, calcul\u00e9 \u00e0 un taux de 20,00 $ CAD par heure, pour chaque cat\u00e9gorie de perte approuv\u00e9e.<\/p>

      Si le Montant de la distribution disponible est insuffisant pour payer toutes les demandes justifi\u00e9es approuv\u00e9es, chaque demande sera r\u00e9duite proportionnellement.\u00a0 Aucune contribution suppl\u00e9mentaire ne sera vers\u00e9e par Capcom.<\/p>
