Plaintiffs Welcome Class Action Certification in Lytton Fire Litigation

The Supreme Court of British Columbia has certified the class action for victims of the devastating Lytton Fire of June 30, 2021, against CN Rail and CP Rail.

The village of Lytton was destroyed during a record-breaking heat wave when a fastmoving wildfire ignited beside the railway tracks minutes after a CP Rail coal train passed.

More than four years later, the community is still working to rebuild. In September 2024, the RCMP concluded its investigation, finding no evidence of arson.

On December 2, 2025, Justice Ward Branch noted that a class proceeding may be “the only tool” available for individuals to realistically seek accountability and justice. Certification marks a major step toward allowing affected residents and property owners to pursue compensation in one unified proceeding.

A common issues trial is expected in 2027.
